  All vision loss cases are adjudicated on a case-by-case basis, and the degree of permanency is a question of fact for the Commission.

Additional Benefits for Injuries Occurring On Or After 2/1/06

 

  • MINIMUM rate for amputation of a member or enucleation of an eye under 8(e) increased to 50% of statewide average weekly wage.
  • Burial expense INCREASED from $4,200.00 to $8,000.00.
  • Death Benefit INCREASED from the greater of $250,000.00 or 20 years to the greater of $500,000.00 or 25 years.
  • Maximum rate for wage differentials 100% of the state average weekly wage.
  • Temporary partial disability: 2/3 of the difference between the average amount the employee would be able to earn in the full performance of his or her duties at the time of the injury and the net amount he is able to earn in the modified job provided by the employer or any other job.
  • Voc. Rehab: Maintenance defined: shall not be less than the employee’s TTD rate. Vocational Rehabilitation counselor must be certified by the state.
  • Section 19(h) filing period increased from 30 to 60 months for Section 8(d)(1)  (wage loss) claims.
  • Section 19(l) penalties increased from $10 to $30/day with maximum increased from $2,500.00 to $10,000.00. Employer must respond within 14 days for explanation of TTD delay.
